1. General Provisions
1.1. This document (hereinafter – Offer) is a public offer of Individual Entrepreneur Koenaliev Aibek Zhooshbekovich (hereinafter – Seller) for the purchase of goods presented on the website https://bosogo.kg (hereinafter referred to as the Website) through the Website in accordance with the terms of this Offer.
1.2. Information about the goods presented on the Website, payment, delivery, and other material terms is an integral part of this Offer.
1.3. This Offer is addressed to individuals (hereinafter – the Buyer).
1.4. Payment for the order by the Buyer is considered an acceptance of the Offer.
2. Ordering Process
2.1. Communication, sending notifications of acceptance (receipt), processing, dispatch of the order, delivery of the purchased goods are carried out on the basis of information provided by the Buyer when placing an order through the Website.
2.2. The Buyer is responsible for the accuracy, reliability, and completeness of the information provided.
2.3. The Buyer must specify an address within the Kyrgyz Republic as the delivery address.
2.4. The Buyer understands and agrees that providing an email address is not mandatory for placing an order; however, if an email address is not provided, the Buyer may not receive automatically sent Notifications.
2.5. By placing an order, the Buyer agrees to the Website’s Privacy Policy.
3. Order Acceptance and Processing
3.1. The notification of order acceptance (receipt) shall be considered a record of an electronic transaction.
3.2. Order processing is carried out in accordance with the business hours specified on the Website.
3.3. In the event of technical errors on the Website resulting in an order for goods at a price significantly lower than their actual cost, the Seller has the right to inform the Buyer and cancel such order.
4. Delivery
4.1. Ownership of the purchased goods passes to the Buyer at the moment the goods are actually handed over to the Buyer.
4.2. Delivery of goods is carried out through a third party engaged by the Seller.
4.3. Delivery costs and delivery times are specified during the ordering process.
4.4. The Buyer is obliged to remain reachable during delivery, answer phone calls from the carrier or the Seller, and be prepared to receive the goods at the delivery address.
4.5. If the goods are not handed over to the Buyer due to the Buyer’s fault (failure to communicate, absence from the delivery address, etc.), the Seller’s delivery obligation shall be considered fulfilled. In such case:
– the risk of accidental damage or accidental loss of the goods passes to the Buyer;
– the Seller has the right to deduct expenses incurred from the return of the goods to the Seller from the amount to be refunded to the Buyer for the goods.
4.6. Upon receipt of the goods, the Buyer is obliged to check the integrity of the external packaging, the quantity, and the completeness of the goods in the presence of the carrier. After the goods have been handed over, claims regarding damage to the external packaging, quantity, and completeness of the goods will not be accepted.
4.7. If the Buyer identifies damage to the packaging or the goods while receiving them from the carrier, the Buyer must refuse to accept the goods and immediately notify the Seller. In such case, the Seller, after inspecting the condition of the goods, will make an appropriate decision in agreement with the Buyer.
5. Returns and Exchanges
5.1. Matters regarding the return and exchange of goods not regulated by this Offer shall be resolved in accordance with the legislation of the Kyrgyz Republic.
5.2. When returning goods of appropriate quality, the Seller has the right to deduct from the refund the expenses incurred by the Seller for the return of the goods.
6. Final Provisions
6.1. The Seller has the right to make changes to the terms of the Offer without prior notice. Such changes take effect from the moment they are published on the Website.
6.2. The original version of this Offer is drawn up in the Kyrgyz language. Its translations are for informational purposes only and have no legal force.
6.3. The Buyer agrees that legal proceedings shall be conducted in the Kyrgyz language, regardless of the language of the claim submitted by the Buyer.
6.4. The Buyer agrees that all disputes not resolved through pre-trial procedures shall be considered in the Oktyabr District Court of Bishkek.
